India introduces rules clearly separating esports from real-money gaming

The government of India has introduced new regulations that distinguish esports and standard online games from real-money gaming. The rules were announced by the Ministry of Electronics and Information Technology (MeitY) on April 22, 2026, and will come into force on May 1.

Previously, online gaming laws in India varied by state, creating confusion. The new framework establishes a unified national system. It also creates the India Online Gaming Authority, which will oversee the ecosystem and enforce the new rules.

Under the new regulations, any online game involving betting or staking money with the expectation of monetary winnings or rewards is fully banned across the country. This applies to games based on skill, chance, or a combination of both.

Online games are now divided into three main categories:

  • Real-money online games (banned): any games involving real-money betting or winnings.
  • Social online games (allowed): free-to-play or non-monetary games, generally subject to minimal regulation.
  • Esports (allowed with regulation): competitive, skill-based games played in tournament formats.

Esports is now clearly separated from gambling and recognized as a legitimate activity. However, the new rules require all unregistered esports titles to undergo official registration and receive government approval. Once approved, a game may receive certification valid for up to 10 years. The government may also support esports through training programs, events, and potential inclusion in national sports policy.

The law предусматривает penalties of up to three years in prison and fines of up to $100,000 for individuals or platforms that offer, facilitate, or promote banned real-money games.
